NHAI Wins Arbitration Cases Worth Rs 8,375 Cr Related to NH-44 Projects

National Highways Authority of India (NHAI) has successfully defended two major arbitration cases linked to the Panipat–Jalandhar section of NH-44, involving claims exceeding Rs 8,375 crore raised by concessionaires.

The disputes related to alleged termination payments, toll revenue losses, escalation costs, extension of concession periods and project delay compensation. After extensive hearings, the arbitral tribunal upheld several key arguments made by NHAI and issued net awards in favour of the authority.

In the first case, claims exceeding Rs 5,443 crore were filed against NHAI over issues including toll collection losses and termination payments. The tribunal rejected major claims and accepted several counterclaims by NHAI, resulting in a net award of around Rs 115.73 crore in favour of the authority.

In the second arbitration, claims of over Rs 2,931.79 crore were made over alleged delay-related losses and escalation costs. The tribunal substantially rejected the claims and upheld NHAI’s counterclaims, awarding a net sum of approximately Rs 704.23 crore to NHAI.

NHAI also highlighted a previous arbitration victory related to the Kamrej–Chalthan section of NH-48 in Gujarat, where claims of Rs 174.49 crore were reduced to an award of only Rs 54 lakh.

The authority said the outcomes reinforce its focus on protecting public funds, enforcing contractual accountability and ensuring financial discipline in national highway projects.
